Welcome to Joshua Buss Irrigation. These Terms & Conditions (“Terms”) govern the use of our website and the services provided by Joshua Buss Irrigation (“Joshua Buss Irrigation,” “we,” “us,” or “our”).


By requesting, scheduling, or purchasing services from Joshua Buss Irrigation, you (“Customer,” “you,” or “your”) agree to these Terms. If you do not agree with these Terms, please do not use our website or request our services.

1. Services


Joshua Buss Irrigation provides irrigation installation, irrigation repair and maintenance, rainwater collection systems, and other related outdoor water-management services.


Services may include, but are not limited to:


  • Irrigation system installation
  • Irrigation system repair
  • Irrigation system maintenance
  • Sprinkler and irrigation troubleshooting
  • Irrigation system inspections
  • Irrigation controller and valve service
  • Rainwater collection systems
  • Pump and related equipment service
  • Outdoor water-management solutions
  • Other services agreed upon between Joshua Buss Irrigation and the Customer


The exact services to be performed will be determined by the estimate, proposal, work order, invoice, service agreement, or other written or verbal agreement between Joshua Buss Irrigation and the Customer.


2. Estimates and Proposals


Unless otherwise stated in writing, estimates and proposals are based on the information reasonably available to Joshua Buss Irrigation at the time the estimate is prepared.


An estimate is not necessarily a guaranteed final price.


Additional work may be necessary when previously unknown conditions are discovered after work begins. These conditions may include:


  • Hidden or damaged irrigation lines
  • Underground utilities or obstructions
  • Unmarked plumbing
  • Rock or unusually difficult soil conditions
  • Existing equipment that is damaged or unsuitable for reuse
  • Drainage or grading issues
  • Electrical problems
  • Previously concealed damage
  • Conditions that could not reasonably be identified during the initial inspection


When practical, Joshua Buss Irrigation will notify the Customer before performing significant additional work that will increase the cost of the project.


3. Changes to the Scope of Work


Requests to add, remove, or modify work may result in additional charges or changes to the project schedule.


Any material changes to the original scope may require a revised estimate, proposal, or work authorization.


Joshua Buss Irrigation reserves the right to adjust pricing when additional labor, materials, equipment, or services are required due to changes requested by the Customer or conditions discovered during the project.


4. Scheduling and Appointments


Service appointments are scheduled based on availability, project requirements, weather, materials, and other operational considerations.


Joshua Buss Irrigation will make reasonable efforts to arrive within the scheduled service window. However, specific arrival times cannot always be guaranteed.


Appointments may be delayed or rescheduled due to:


  • Severe weather
  • Emergencies
  • Equipment failure
  • Material availability
  • Traffic or travel conditions
  • Unexpected conditions at another job
  • Safety concerns
  • Other circumstances outside our reasonable control


Customers will be notified when reasonably possible if a scheduled appointment needs to be changed.


5. Customer Access and Property Conditions


The Customer is responsible for providing Joshua Buss Irrigation with reasonable access to the property and areas necessary to perform the requested services.


The Customer should identify known underground utilities, irrigation lines, septic systems, wells, private electrical lines, landscaping features, or other concealed conditions that may affect the work.


Joshua Buss Irrigation will exercise reasonable care while performing services. However, we are not responsible for damage resulting from concealed, unmarked, inaccurately marked, or improperly installed utilities, irrigation components, plumbing, wiring, or other underground or hidden conditions.


6. Underground Utilities


Before excavation or other work involving digging, the Customer is responsible for ensuring that applicable underground utilities are properly identified and marked.


Joshua Buss Irrigation may use available utility-location services when appropriate. However, privately installed or unmarked utilities may not be identified by standard utility-locating services.


The Customer is responsible for identifying private utilities, including but not limited to:


  • Private electrical lines
  • Landscape lighting wiring
  • Irrigation wiring
  • Private water lines
  • Septic lines
  • Low-voltage systems
  • Gas lines located on private property
  • Other privately installed underground systems


Joshua Buss Irrigation is not responsible for damage to concealed or improperly marked utilities or systems.


7. Materials and Equipment


Joshua Buss Irrigation may select materials and equipment reasonably appropriate for the project unless a specific product or manufacturer has been agreed upon with the Customer.


Product availability may change. When necessary, comparable materials or equipment may be substituted with Customer approval when reasonably practical.


Manufacturer warranties, when applicable, are separate from any labor or workmanship warranty provided by Joshua Buss Irrigation.


8. Customer Responsibilities


The Customer agrees to:


  • Provide accurate contact and property information
  • Provide reasonable access to the property
  • Disclose known underground utilities and property conditions
  • Provide access to necessary water and electrical connections when required
  • Obtain any approvals or permissions that are the Customer's responsibility
  • Keep pets and other animals safely away from work areas
  • Remove personal belongings or items that may interfere with the work
  • Make timely payments for services and materials
  • Notify Joshua Buss Irrigation of any concerns as soon as reasonably possible


The Customer is responsible for obtaining permission from property owners, landlords, homeowners' associations, or other parties when required.


9. Permits and Approvals


When permits, inspections, HOA approvals, utility approvals, or other governmental or private approvals are required, responsibility for obtaining those approvals will be determined as part of the project agreement.


Unless specifically included in a written proposal, Joshua Buss Irrigation is not responsible for obtaining permits or approvals that are the Customer's responsibility.


10. Irrigation System Performance


Irrigation systems depend on many factors, including water pressure, water availability, system design, existing plumbing, soil conditions, drainage, weather, landscaping, plant requirements, and proper system maintenance.


Joshua Buss Irrigation does not guarantee that an irrigation system will provide uniform watering or specific landscape results when conditions outside our control affect system performance.


Existing systems may contain components that are worn, damaged, outdated, improperly installed, or incompatible with new equipment.

Repairs to one portion of an existing irrigation system may reveal additional problems that were not visible or reasonably discoverable before work began.


11. Rainwater Collection Systems


Rainwater collection system performance depends on rainfall, roof area, collection surfaces, storage capacity, water demand, filtration, pumping equipment, and other environmental and system conditions.


Joshua Buss Irrigation does not guarantee a specific amount of collected water or uninterrupted water availability.


Customers are responsible for maintaining systems after installation unless an ongoing maintenance agreement has been established.


12. Weather and Environmental Conditions


Certain services may be affected by weather or site conditions.


Joshua Buss Irrigation may delay, suspend, or reschedule work when weather or environmental conditions create an unsafe working environment or could negatively affect the quality of the work.


Examples include:


  • Heavy rain
  • Flooding
  • Lightning
  • Extreme heat
  • Freezing conditions
  • Severe storms
  • Saturated soil
  • Unsafe site conditions


Weather-related delays do not constitute a breach of these Terms.


13. Payment Terms


Payment is due according to the terms stated on the applicable estimate, proposal, invoice, service agreement, or work order.


Unless otherwise agreed in writing, payment is due upon completion of the applicable service or when invoiced.


Accepted payment methods may include credit card, debit card, electronic payment, check, or other payment methods made available by Joshua Buss Irrigation.


Customers are responsible for providing accurate billing information.


14. Deposits and Progress Payments


Certain projects may require a deposit or progress payment before work begins or as the project progresses.


The amount and timing of any required deposit or progress payment will be stated in the applicable proposal, estimate, invoice, or service agreement.


Deposits may be used to purchase materials, reserve labor, schedule equipment, or otherwise prepare for the project.


15. Late or Unpaid Balances


Unpaid balances may be subject to collection efforts and any legally permitted fees or charges.


Joshua Buss Irrigation reserves the right to suspend or refuse additional services for accounts with overdue balances.


Any collection costs, attorney fees, or other charges will only be pursued to the extent permitted by applicable law and any applicable written agreement.


16. Cancellations and Rescheduling


Customers should provide reasonable notice when canceling or rescheduling an appointment.


Joshua Buss Irrigation reserves the right to charge a cancellation, trip, restocking, or other reasonable fee when such a fee has been disclosed in advance or agreed upon in writing.


Custom-ordered materials, specially purchased equipment, or materials already installed may be subject to payment or restocking charges.


17. Warranty and Workmanship


Joshua Buss Irrigation will perform its services in a professional manner consistent with generally accepted industry practices.


Any specific workmanship warranty will be stated in the applicable estimate, proposal, invoice, or service agreement.


Manufacturer warranties on products and equipment are subject to the manufacturer's terms and conditions.


Unless otherwise stated in writing, Joshua Buss Irrigation does not warrant:


  • Existing equipment or components that were not installed by Joshua Buss Irrigation
  • Damage caused by misuse, neglect, accidents, freezing, storms, animals, landscaping work, construction, or other outside causes
  • Damage caused by unauthorized modifications or repairs
  • Normal wear and tear
  • Problems caused by water pressure or water supply issues outside our control
  • Problems resulting from failure to properly maintain the system
  • Damage caused by concealed or pre-existing conditions


Customers should notify Joshua Buss Irrigation promptly if they believe there is a workmanship issue so that the matter can be inspected and addressed when appropriate.


18. Existing Systems and Repairs


When repairing an existing irrigation or water-management system, Joshua Buss Irrigation cannot guarantee the condition or performance of components that are not repaired or replaced.


Repairing one component may place additional operating stress on older components and may reveal other failures.


Joshua Buss Irrigation will make reasonable efforts to identify known problems and communicate recommended repairs to the Customer.


19. Property Damage


Joshua Buss Irrigation will exercise reasonable care when performing work.


Some services, particularly irrigation installation, excavation, trenching, drilling, landscaping-related work, and underground repairs, may require disturbing portions of soil, grass, landscaping, or other surfaces.


Reasonable restoration of affected areas may be included when specifically stated in the project agreement.

Natural settling, soil movement, grass recovery, plant recovery, and similar conditions may occur after work and are not necessarily considered defective workmanship.


20. Photos and Documentation


Joshua Buss Irrigation may take photographs or other documentation of work performed for purposes including:


  • Project records
  • Estimates and proposals
  • Quality control
  • Warranty documentation
  • Customer service
  • Before-and-after documentation


Joshua Buss Irrigation will not intentionally use identifiable customer information for public marketing without appropriate permission.


21. Website Use


Information provided on the Joshua Buss Irrigation website is intended for general informational purposes.


We make reasonable efforts to keep website information accurate and current, but we do not guarantee that all information is complete, current, or error-free.


You agree not to misuse the website, interfere with its operation, attempt unauthorized access, or use the website for unlawful purposes.


22. Third-Party Products and Services


Joshua Buss Irrigation may use products, equipment, manufacturers, suppliers, software platforms, payment processors, communication services, or other third-party services.


Joshua Buss Irrigation is not responsible for the independent acts, omissions, policies, warranties, or performance of third parties.


Any manufacturer's warranty is governed by the manufacturer's warranty terms.


23. Limitation of Liability

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.


24. Force Majeure


Joshua Buss Irrigation is not responsible for delays or failure to perform caused by circumstances beyond our reasonable control.


These circumstances may include:


  • Severe weather
  • Natural disasters
  • Fire
  • Flooding
  • Utility failures
  • Material shortages
  • Transportation delays
  • Labor shortages
  • Government actions
  • Public emergencies
  • Equipment failures
  • Acts of God
  • Other events beyond our reasonable control


When such circumstances occur, we will make reasonable efforts to resume or reschedule services when conditions permit.


25. Disputes and Governing Law


These Terms shall be governed by the laws of the State of Texas, to the extent applicable.


If a dispute arises concerning services, the parties agree to first make a good-faith effort to resolve the matter directly before pursuing formal legal action.


Nothing in these Terms prevents either party from exercising rights or remedies that cannot legally be waived or limited.


26. Changes to These Terms


Joshua Buss Irrigation may update these Terms & Conditions from time to time.


When changes are made, the updated version will be posted on this website with a revised effective date.


Your continued use of our website or continued request for services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.


27. Severability


If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.


28. Entire Agreement


These Terms, together with any applicable estimate, proposal, invoice, service agreement, work order, warranty, or other written agreement between Joshua Buss Irrigation and the Customer, constitute the applicable agreement regarding the services provided.


If there is a conflict between these Terms and a specific written service agreement, the specific written service agreement will control to the extent of the conflict.

30. Acceptance of Terms


By requesting, scheduling, or purchasing services from Joshua Buss Irrigation, you acknowledge that you have had an opportunity to review these Terms & Conditions and agree to be bound by them to the extent permitted by applicable law.
